Consultation
The divorce process typically begins with a legal consultation, where an individual meets with a family lawyer to discuss their situation, rights, and options. Filing for Divorce
One party (the Plaintiff) files a Writ for Divorce, Statement of Claim, and Statement of Particulars in the Family Justice Courts. This includes stating the grounds for divorce (e.g. unreasonable behaviour, separation, etc.).

Services & Response
The divorce papers are served to the other party (the Defendant), who may either agree (uncontested) or contest the divorce. If contested, both parties will need to attend mediation or court hearings.

Judgement
If the court finds that the marriage has irretrievably broken down, it will grant an Interim Judgment, which is a temporary divorce order. Ancillary matters like child custody, division of assets, and maintenance are addressed next, once all ancillary matters are resolved and a minimum of 3 months has passed from the Interim Judgment, a Final Judgment (Certificate of Final Judgment) is issued, officially dissolving the marriage.
